This is the basic pet contract.  I am putting it here for you to read and ask questions of....   A contract is to inform and make clear all the different possibilities of life.  I am concerned that we completely understand what is expected of us.
 
Thank you for taking the time.   This contract is the result of years of experience collected from others as well as my own.   I also have had legal help in writing some of this, other parts I have simply added for clarity.   There is a preliminary contract that does not name sire/dam/birth date, but is a generalized contract that is sent if a person wants to give a deposit.   The contracts are the same, only when a final selection of a kitten is made, the parts are filled in for identification.  I do this to allow for even more time for reading, discussing, and asking of questions.  Again, my goal is to educate with this document.

This contract is between Akerrs Bengal cats and  ---------.    (In here I put any details, such as spay/neuter, rebates, any changes that the client has asked about concerning the contract.)

Guarantees from the Buyer to Akerrs Bengal cats.

  1.  If, at any time, this kitten cannot remain with me, I will contact Akerrs Bengal cats for advice. 

  2. I will, under no circumstance , sell, lease, or give this kitten to any shelter, research facility, pet store or similar facility.

  3. I will keep this kitten indoors with room for play and activity, interaction with people, and  provide scratching posts, proper nutrition, litter boxes, and attention. 

  4. If I take the  kitten outside, it must be leashed, in a safe area, and under proper conditions for safety… it will not be allowed to roam freely.   (Free roam cats have a life expectancy  of three years)

  5.  I will neuter /  spay the kitten before sexual maturity of five to six months.   I will have Akerrs Bengal cats do the neuter / spay prior to release of the kitten, unless other arrangements have been made in writing.  Papers are held until proof of altering. 

  6. I understand that there are no cash refunds.

  7. I will have my veterinarian direct any and all questions to the Powell Vet clinic at 614-436-9922 concerning health questions.   I understand that failure to do so makes all guarantees null and void.   This is a phone contact only.

  8.  I understand that I must keep the kitten separate from all other cats/kittens in the household until I am satisfied that the kitten is in excellent health and the kitten meets my expectations.   I understand that my failure to isolate the kitten makes all guarantees null and void.  

  9.  I will keep the kitten’s vaccines up to date, following the recommendations of the veterinarian of my choice.

  10.  I understand that Akerrs Bengal cats does not declaw any of the kittens and if I should chose to do so, all guarantees are null and void.

  11. I understand Akerrs Bengal cats has done everything to optimize the socialization of the kitten and I agree to work with the kitten and provide a safe, exploratory environment.   Any behavior problems must be directed to Akerrs Bengal cats in a timely matter!

  12. To the best of my knowledge and that of my veterinarian, the kitten/cat is free of zoonotic diseases. With live animals, there is always the risk of zoonotic disease especially in immuno-suppressed patients, pregnant mothers-to-be, or children. Inform your doctor of your new family addition if these conditions apply to you.  If you have young children, be aware that if they contract Campylobacter or Streptococcal bacterial infections, they can pass this on to your cat or kitten. Some water supplies may contain giardia or other organisms that may pose a risk for your kitten or cat. In no case will AKerrs be held responsible for medical expenses related to this kitten.

Assurances to Buyer from Akerrs Bengal cats.

  1. Powell Vet Clinic has seen this kitten at least three times, they have worked with Akerrs Bengal cats since 1989.  Administered vaccines and checked for any defects.  Powell Vet Clinic can be contacted for a phone consultation by your veterinarian.    Kitten is identified by: date of birth, mother’s name, and foot marking.

  2. A growth, temperature, general health and vaccine record is given with each kitten.  A post card for your veterinarian to fill out and drop in the mail to Akerrs Bengal cats must be sent back to Akerrs Bengal cats to show the health evaluation of your vet in the guarantee period.  The phone consultation is there for you as a benefit.  It is what assures you of the health and care of the kitten.

  3. Vaccines given:  FPL/CVR.   We no longer give the FeLV vaccine and recommend it be given at six months of age, however, if cat or kitten is  in contact with cats that are not tested as negative for FeLV then Buyer should go by veterinarian’s advice.   Rabies vaccine given according to the laws of Buyer’s state.  Strict worming schedule followed.

  4. Temperament is very important to me.  I handle the kittens daily from the moment of birth and work to keep them in an optimum environment for their development.   I can only warrant temperament that is expressed here and assist you once the kitten is in your home.

  5.  All my cats are registered.  All pedigrees are available.   If circumstances are that you are making the arrangements for the spay and neuter with your veterinarian, then Akerrs Bengal cats will hold the registration papers until written notification of the neuter or spay from the acting veterinarian.   

  6. I will have my cattery inspections and qualifications kept current.   I will keep up to date on issues concerning feline health and behavior.

  7. I will always be available to you in a reasonable time frame.

  8. In May, 2010 Akerrs began testing for Tritrichomona Foetus (Tri Trich or TF).  While most cats clear the protozoan by six to nine months of age there is effective treatment that can begin at 4 months of age.  TF causes diarrhea in some cats but not all and not all diarrhea is TF.  We are testing to make sure you are informed but can only give the information we have through testing while the cat is here.  Test results take 3-10 days, treatment at four months is a daily capsule for two weeks.  

   Beyond our control… Life Guarantees 

  1. Kitten must be taken to Buyer’s veterinarian to assure Buyer of the health of the kitten in the first seven days of ownership.  This must be done before exposing established cats in a household to kitten and exposing kitten to established cats.   This is done at Buyer’s expense.   Your vet MUST contact mine if there are any questions.

  2. If the veterinarian discovers the cat is not in good health as guaranteed, the BUYER must contact the SELLER immediately and the BUYER must provide the SELLER with a written explanation signed by the BUYER'S veterinarian as the illness that has been determined.  (We suggest that you place the new kitten in quarantine during this time, if not longer)  If the cat or kitten can't be cured, the SELLER will replace the kitten with one of equal value as soon as a kitten/cat is available.

  3. It is the responsibility of the Buyer to provide immediate veterinary care to any kitten showing signs of illness or distress and failure to do so will render any guarantee null and void. 

  4. The Buyer’s vet must contact Powell Vet Clinic if there are any health questions.  614-436-9922

  6. Akerrs Bengal cats cannot guarantee that a kitten does not have a corona titer, I can guarantee that I follow the best possible practices known, test the adults, and follow guidelines for making sure that exposure risk is minimum.   There is no good test nor is there a proven vaccine.  I promise to do all I can to make your kitten’s environment the safest possible and will replace any kitten that succumbs to FIP in the first year, which is the year at risk.  Akerr’s Bengal cats is responsible only for the Akerr’s cat/kitten.  

  7. The Bengal cat has had incidents of hypertrophic cardiomyopathy (HCM).  The only test is an electrocardiogram it is recommended that it be given after 2 years of age.  Akerrs tests and works at remaining HCM free but the testing and mode of inheritance is incomplete in what it reveals or does not reveal.    

  8.  Fatal congenital defects (that might not be apparent in early life) are covered as follows:  The first year: 100%; the second year: 80%; the third year: 60%; the fourth year: 40%; the fifth year: 20%.  These percentages are for the replacement of the cat or kitten with the first available cat or kitten from AKerrs Bengal cats. 

     THIS CONTRACT IS LEGALLY BINDING TO ALL PARTIES INVOLVED.  Any legal fees incurred in upholding this contract will  be paid by the purchaser.  Venue is in the State of Ohio, in the County of Delaware.
